| 1 General
provisions |
The present
conditions govern the sale of Euratlas® (1) graphic vector
products, and the supply of specific services.
Every order must unambiguously identify the buyer’s name and company name. The order implies buyer’s acceptance
without reservation of the present terms and the End-User Agreement for Digital Data here below. Special provisions
expressly agreed by means of agreement, contract or covenant are reserved. |
| 2 Price list
|
The
prices of the Euratlas® vector map files published by Christos Nüssli
and their reproduction components appear in a price list
prepared annually. The price applicable to any order is the price in
effect on the date the order is given. Prices are understood to be in euro. |
| 3 Liability |
The
utmost care is taken in producing the Euratlas maps and cartographic bases, but the
information appearing therein is merely indicative and does not render the author
liable in the event of direct or indirect damage deriving from its application or
its unsuitability for the user’s particular needs. In any case, Buyer
acknowledges that it has, before buying, examined the sample model freely
downloadable from here and the maps of the Periodical Historical Atlas
of Europe available at https://www.euratlas.net/PHA/summary.htm in image
mode and he may not claim any defect if the vector files
supplied match the models. |
| 4 Right of ownership |
The Euratlas® vector
map files are original works protected by intellectual property legislation. Purchase of maps in digital format
does not carry with it the transfer in favour of Buyer of the exclusive
rights of ownership attaching thereto. Any use, in particular graphic or digital
reproduction, adaptation for purposes of representation or
dissemination to third parties, as is or in derivative products, in whatever form or by
whatever means or technical process, must be the object of a written request. It
is subject to payment of fees corresponding to the planned utilisation, invoiced at the list price in
effect on the date of the order. The Buyer of the vector files acknowledges
that it is not entitled to use them on more than one computer at a time and that
it is not entitled to transfer them to a third party, for any reason whatsoever. |
| 5 Adaptation
and enhancement |
In order to
meet its own needs, Licensee is authorised to adapt the Euratlas vector files, to
enhance them, and to cross the data provided with its own or with data from
third parties, so long as the modifications thus made undoubtedly do not lead
to illegal, discriminatory or scientifically erroneous elements in the
final work. It is furthermore imperative that the documents thus created bear the
words:
"© Copyright Christos Nüssli – www.euratlas.net, year of
publication, reproduction prohibited, license number". No adaptation or
enhancement, regardless of percentage, entitles Buyer
to a reduction in the amount set forth in the price list. Christos
Nüssli reserves the right to refuse a request when the
planned utilisation of the vector files is not clear. |
| 6 Licensing procedure |
After having
accepted the present terms and the End-User Agreement for Digital Data
here below, the Buyer will be required to supply personal information. The End-User
Agreement for Digital Data expressed in same terms will be sent by
letter. Christos Nüssli reserves the right to refuse the End-User
Agreement for Digital Data if the provided data are undisputably fake.
Each End-User will be entitled to download both
English and French editions of the Periodical Historical Atlas of
Europe Basic version 1.2. |
| 7 Court |
The present
terms are subject to Swiss law. The court having jurisdiction is at Yverdon-les-Bains, Vaud. |

EURATLAS®, SWITZERLAND: END-USER AGREEMENT FOR DIGITAL DATA |
This is a legal Agreement between XXXXXXXX XXXXXX, the "End-User" and Christos
Nüssli, legal holder and owner of the Periodical Historical Atlas of
Europe and of the trademark Euratlas.
By accepting the digital historical and topographic data delivered with
this agreement, you are agreeing to be bound by the terms of this
agreement. If you do not agree to the terms of this agreement, do not
purchase the digital topographic data. |
Whereas Christos Nüssli is the owner of the proprietary rights in the
digital data Euratlas® vector map files delivered with this Agreement;
whereas the End-User wishes to obtain the right to use the Data;
and whereas Christos Nüssli is prepared to license to the End-User
the right to use the Data for the End-Users' own internal use subject
to the terms and conditions hereinafter set forth;
now, therefore, Christos Nüssli and the End-User for valuable
consideration, the receipt and sufficiency of which is hereby
acknowledged by the parties, covenant and agree as follows: |

1. The End-User acknowledges that the Euratlas® vector map files are
original works protected by intellectual property legislation. |
2. The Data is licensed, not sold, to the End-User for the intended use here below,
subject to the terms and conditions of this Agreement. The End-User owns the disk(s) or tape(s)
on which the Data is recorded, but Christos Nüssli retains all ownership interests in the Data.

3. Except as provided in Articles 4 and 6, the End-User shall use the Data only for
the End-User's own internal use. A
commercial use or an use for cultural or educational purposes such as
publication of a work, illustration of an article, exhibition,
documentary or similar work etc. may be allowed with the prior specific
consent of Christos Nüssli. The latter reserves the right to
refuse the licence if the main planned use is the publication of a
historical atlas.

4. The End-User shall reproduce the following Copyright Notice on all copies
of the Data:
"© Copyright Euratlas Nüssli – www.euratlas.com, reproduction prohibited, year of publication,
license number" |

5. The End-user may loan the Data to a person under contract with the
End-User solely for the purpose of providing a service to the End-User
that requires the use of the Data; provided that the person is under a
written obligation to return all copies of the Data upon completion of the contract project and so long
as the modifications thus made undoubtedly do not lead to illegal,
discriminatory or scientifically erroneous elements in the final work.

6. Except as provided in Articles 3 and 5 above, the End-User shall not authorize or
allow any third party to duplicate or reproduce the Data, in whole or
in part, in any form or format whatsoever without the prior written consent of Christos
Nüssli, nor sell, loan, lease, distribute, transfer or sublicense
the Data or otherwise assign any rights under this Agreement to any
third party without the prior written consent of Christos Nüssli.

7. The Data is provided on an "as is"
basis and Christos Nüssli makes no
guarantees, representations or warranties respecting the Data, either
expressed or implied, arising by law or otherwise, including but not
limited to, effectiveness, completeness, accuracy or fitness for a
particular purpose. |

8. Christos Nüssli shall not be liable in respect of any claim, demand or
action, irrespective of the nature of the cause of the claim, demand or action alleging any loss,
injury or damages, direct or indirect, which may result from the
End-User's use or possession of the Data. Christos Nüssli shall
not be liable in any way for loss of revenue or contracts, or any other
consequential loss of any kind resulting from any defect in the Data.

9. The End-User shall indemnify and save
harmless Christos Nüssli, its employees and agents from and
against any claim, demand or action, irrespective of the nature of the
cause of the claim, demand or action, alleging loss, costs, expenses,
damages or injuries (including injuries resulting in death) arising out
of the End-User's use or possession of the Data. |

10. This Agreement shall be interpreted in accordance with the laws in force in
Switzerland. The court having jurisdiction is at Yverdon-les-Bains, Vaud. |
